EMI Has A Problem With Kim Davis And Mike Huckabee’s Use Of ‘Eye Of The Tiger’

EMI will sue Kim Davis and Mike Huckabee over their unauthorized use of ‘Eye of the Tiger’ at their public appearance! I could not resist to spread the news, because they both deserve it so much!

In a over-the-top move, potential presidential nominee Mike Huckabee organized a rally to support Rowan County Clerk Kim Davis, at the moment of her release from jail. In case you were sleeping under a rock, she spent five days in jail because she denied marriage licenses to same sex couples, despite the new law authorizing gay couples to get married legally…

The problem is that Huckabee and Davis supporters used the Rocky III song to welcome Davis, without asking anyone’s authorization. Record label EMI didn’t appreciate, and intellectual property attorney Paul W. Steiner issued this statement:

‘They are well within their rights to hold a public rally in support of Kim Davis, or anyone else for that matter. Where they broke the law was when they played that song by Survivor without the permission of the rights holder.

As far as I have heard, no one secured the rights to that public performance of ‘Eye of the Tiger’ and as a result they violated EMI’s intellectual property rights today. It is illegal for someone to ignore IP law and would make the offending parties guilty of infringement under Copyright Law (17 U.S.C. § 501(a)).’

What was that anyway, what fight did Huckabee think Davis had won to compare this woman to Sylvester Stallone’s character? This circus has turned more ridiculous every day, not only Davis dared to compare her stupid fight against the law to Dr. Luther King’s fight for civil rights, but now her supporters think she is Rocky balboa? That’s the problem with people who are too religious, they always think they embark into the epic historic combat for moral rights, they always think they are the heroes turned martyrs, when they are actually the bigots trying to make history do a U-turn. I once had an endless discussion with a Jehovah witness who was rejecting evolution to promote her creationist views of the world and she dared to compare herself to Galileo ‘whose ideas had first been rejected by the majority’… How fucked up was this reasoning?! ‘I am sorry but, in the story, I am Galileo!’ I replied. And it’s the same old story here, Davis tries to pass her backward views for the moral, enlightened and noble ones with this Martin Luther King comparison and a Rocky soundtrack. What a twisted mess these people have for a brain!

‘Many times, a record company will look the other way in a situation like this, as it serves as free publicity for their intellectual property,’ added Steiner. ‘Though, in this case, I believe that EMI does not want their song associated with someone like Kim Davis, or Mike Huckabee for that matter, and will most likely seek full damages for this incident.’ And although I usually find lawsuits of this sort a waste of time, I hope that they will get the maximum punishment this time.
