If I went back in time to every time I got hurt in a club I could make a pretty big list. If I sued and won I would be a wealthy gal.
I have done everything from fall down coliseum stairs (those things are too narrow and my heels are too high) to getting hit with a table in a bar fight. Shit happens and you can’t control your surroundings. I wouldn’t expect compensation for any of it. Its calculated risk and you get what you get.
I was pinned to a barricade at a Clash show in which Joe Strummer stops the show, security comes out to remove the barrier and Strummer himself gets me on to the stage to prevent my getting crushed. Did I sue the venue for the damage to my girlie self? Hell no- I sucked it up and soldiered on.
Not the case these days though. Yusef Allen wants coin from the Hammerstein Ballroom cuz some dude fell on him from the balcony. First off shouldn’t the guy who went over the balcony be the one crying no protection?! You really cant predict a human will fall from the sky and land on you so what exactly are the precautions Hammerstein could have taken?
What a pathetic lawsuit. The charges are against the venue for “permitting concertgoers to be unruly; in permitting excessive amounts of alcohol” and “failing to furnish proper guardrails on the upper levels and balconies.”
Glenn Faegenburg, an attorney for Allen, told the paper his client “absorbed the impact” of the Oct. 21 accident, leaving him with multiple spinal fractures, ligament damage in his knee that required two surgeries and “the speed with which he can call up words has been affected.”
If this guy wins- the legal system is a hot mess. Wait, we already know that, but it’s a disgrace.
